1. Service overview

nutritious.love ("the Service") is an AI-powered nutrition tracking tool operated by Josef Richter (sole proprietor). The Service allows you to log meals by text description, photo, voice, or nutrition label scan, and estimates nutritional values using artificial intelligence.

By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement.

3. Accounts and authentication

• You may use the demo without creating an account. Demo entries are automatically deleted after 3 days.
• To save your data, you must register with a valid email address. Authentication is handled via magic links — no password is required.
• You are responsible for maintaining access to the email address associated with your account.
• You may not create multiple accounts to circumvent rate limits or other restrictions.

4. AI-generated content and accuracy

Nutritional estimates provided by the Service are generated by artificial intelligence and may be inaccurate. Specifically:

• AI estimates of calories, protein, carbohydrates, and fat are approximations and may differ from actual values.
• Photo analysis and nutrition label parsing may misidentify foods or misread labels.
• Portion sizes are estimated and may not reflect your actual serving.

The Service is not a medical device and is not intended for medical use. Do not rely on it for medical, dietary, or health decisions. Always consult a qualified healthcare professional for nutritional or dietary advice, especially if you have allergies, intolerances, or medical conditions affected by diet.

5. Subscriptions and payments

• Free tier — the Service offers limited free functionality. Details of current plan limits are shown in the app.
• Paid subscriptions — paid plans are billed monthly via Stripe. Prices are displayed before purchase.
• Cancellation — you may cancel your subscription at any time. Access continues until the end of the current billing period. No partial refunds are issued for unused time.
• Price changes — we may change subscription prices with at least 30 days' notice. Existing subscribers will be notified by email before any price increase takes effect.
• Refunds — refund requests are handled on a case-by-case basis. Contact josef.richter@me.com within 14 days of a charge.

6. Acceptable use

You agree not to:

• Use automated tools, bots, or scrapers to access the Service.
• Attempt to circumvent rate limits, authentication, or security measures.
• Upload malicious content, malware, or content that violates applicable law.
• Use the Service to harm, harass, or infringe on the rights of others.
• Reverse engineer or attempt to extract the source code of the Service.

Demo accounts are rate-limited to 5 entries per day per IP address. Authenticated users are not subject to this limit under normal use.

7. Your content

You retain ownership of the content you submit (food descriptions, photos, labels). By using the Service, you grant us a limited license to process this content solely for the purpose of providing the Service — including sending it to our AI provider (OpenAI) for analysis.

You are responsible for ensuring you have the right to submit any content you upload.

8. Third-party services

The Service relies on third-party providers to function. These include:

• OpenAI — for AI-powered food analysis and transcription.
• Stripe — for payment processing.
• Fly.io — for hosting and infrastructure.
• Resend — for email delivery.

We are not responsible for the availability, accuracy, or actions of third-party services. Their use is subject to their respective terms and policies.

9. Data and privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Account termination

• By you — you may request deletion of your account and all associated data at any time by emailing josef.richter@me.com from your registered email address. We will process your request within 30 days.
• By us — we may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

11. Service availability

We strive to keep the Service available but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify or discontinue the Service (or any part of it) at any time, with reasonable notice where practicable.

12. Limitation of liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• We are not liable for any health consequences resulting from reliance on AI-generated nutritional estimates.
• Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.

Nothing in these Terms excludes or limits liability for matters that cannot be excluded or limited under applicable law (such as fraud or gross negligence).

13. Governing law and disputes

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic. If you are a consumer in the EU, you retain any mandatory consumer protections provided by the law of your country of residence.

You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via the app or email at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and request account deletion.
